1. Agreement to Terms

By accessing or using the Bailamigo website at bailamigo.com and the Bailamigo mobile application (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Bailamigo ("Company," "we," "our," or "us").

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

To access certain features of the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or incomplete.

4. Use of the Service

4.1 Permitted Use

The Service is designed to help dancers:

  • Discover and browse dance festivals worldwide
  • Coordinate attendance and build festival schedules
  • Connect with other dancers and the dance community
  • Share and view festival-related information

4.2 Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation
  • Harass, abuse, threaten, or intimidate other users
  • Post or transmit any content that is offensive, defamatory, obscene, or otherwise objectionable
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems
  • Use automated means (bots, scrapers, etc.) to access or collect data from the Service
  • Interfere with or disrupt the Service or servers/networks connected to the Service
  • Use the Service to send spam, unsolicited messages, or promotional material
  • Sell, resell, or commercially exploit any part of the Service without our prior written consent

5. User Content

You may submit, post, or share content through the Service, including profile information, photos, festival reviews, and other materials ("User Content"). By submitting User Content, you:

  • Retain ownership of your User Content
  • Grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and providing the Service
  • Represent that you have the right to submit such content and that it does not violate any third-party rights
  • Acknowledge that we may remove any User Content that violates these Terms or is otherwise objectionable

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Bailamigo and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Third-Party Services

The Service may contain links to or integrate with third-party websites, services, or applications (including Facebook, Google, and Apple for authentication). We are not responsible for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party services.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

9. Subscriptions and Payments

Certain features of the Service may require a paid subscription ("Premium Features"). If you choose to subscribe:

  • You agree to pay all applicable fees as described at the time of purchase
  • Subscriptions will automatically renew unless cancelled before the renewal date
  • You can cancel your subscription at any time through your app store account settings
  • Refunds are subject to the policies of the applicable app store (Apple App Store or Google Play Store)

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not guarantee the accuracy or completeness of any festival information, user profiles, or other content available through the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAILAMIGO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bailamigo and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by deleting your account through the app settings or by contacting us. Upon termination, your right to use the Service will immediately cease.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bailamigo operates, without regard to its conflict of law provisions.
